William S Nelson commented on James Valvo's blog post 'Help Stop the EPA Power Grab!'
From the Clean Air Act of 1990, neither CO2 nor methane are on the list of polutants that can be controlled. What legislation is proposed to add to the listed of controllable items? Frankly, it seems that the horse is out of the barn. If they can…

In fact, if the CAA is capable of handling greenhouse gases, the EPA is statutorily obligated to regulate all the way down to 250 tons per year. They cannot and will not do that. Thus, very simply, the CAA is the wrong vehicle.

No, Mr. Valvo is correct. The Clean Air Act makes no reference to greenhouse gases. That is why the EPA is trying to assert regulatory authority it does not have.

Help Stop the EPA Power Grab!

The Obama Administration is pursuing perhaps its biggest power grab yet. Climate Czar Carol Browner is trying to have the EPA regulate carbon dioxide as a pollutant under the 1970 Clean Air Act, a sweeping global warming regulatory agenda without a vote of Congress.

Their biggest problem is the law. The 1970 Clean Air Act clearly does not allow them to regulate the way they want. If the EPA insists on shoehorning greenhouse gas regulation into the 1970 Clean Air Act, the result will… Continue

EPA Overreach: Tailoring Themselves into a Corner

President Obama has promised the world the United States will take definitive action on carbon emissions and he needs to have something to show for this promise at the looming global climate conference in Copenhagen. One problem, the American people hate greenhouse gas regulations and they’ve been talking to their representatives in Congress—that’s why cap-and-trade is stalled in the Senate. That’s where the Environmental Protection Agency comes in. The Obama administration is so desperate to… Continue

Carbon Offsets in Waxman-Markey Offshore Jobs and Wealth

The Left demagogues free trade policies, claiming they offshore jobs and siphon American wealth. However, an international carbon offset provision in the Waxman-Markey energy bill could cost the nation millions of jobs and billions of dollars. An offset is a project that reduces, avoids or sequesters greenhouse gas emissions.

Cap-and-trade needs offsets for two reasons. First, Congress needs to avoid forcibly shutting down companies that can’t keep up with the mandated reduction… Continue

30,000 AFP Members Demand Access to Domestic Energy Supplies

Yesterday, Americans for Prosperity submitted the largest public comment filing in the group’s history. More than 30,000 AFP members submitted comments in response to the Department of Interior’s request for input on its new 5-year leasing program in the Outer Continental Shelf (OCS). AFP’s members urged the Obama administration to approve all 31 pending leases in the OCS to help bring more domestic supply online.

The Obama administration is poised to lend $2 billion from U.S.… Continue
