The Obama Administration is pursuing perhaps its biggest power grab yet. Climate Czar Carol Browner is trying to have the EPA regulate carbon dioxide as a pollutant under the 1970 Clean Air Act, a sweeping global warming regulatory agenda without a vote of Congress.

Their biggest problem is the law. The 1970 Clean Air Act clearly does not allow them to regulate the way they want. If the EPA insists on shoehorning greenhouse gas regulation into the 1970 Clean Air Act, the result will be regulation of millions of businesses, warehouses, and even schools. Instead, they want to create new rules pretending the law says something it doesn’t.

They call it the “tailoring rule,” because they are attempting to tailor their regulations to just the particular industries they want to regulate. Even worse, the tailoring rule is unlikely to be effective, instead opening up a floodgate of regulations from state regulators and judges who will not be bound by the EPA rule. They will be free to regulate everything that moves and lots of things that don’t.

From the Clean Air Act of 1990, neither CO2 nor methane are on the list of polutants that can be controlled. What legislation is proposed to add to the listed of controllable items?

Frankly, it seems that the horse is out of the barn. If they can get CO2 listed as a pollutant, then there is nothing that can stop the implementation. I read the "tailoring rule", and frankly, anything from the govenment that starts "no impact" and "cost savings" I find hilarious.
