A federal judge in Virginia has allowed the state's lawsuit challenging the federal individual health care mandate to proceed: On Monday, the judge refused to dismiss the State of Virginia’s challenge to Obama’s new healthcare law, a setback that will force his administration to mount a lengthy legal defense of it. More details here. The lawsuit argues that the law violates the Constitution's commerce clause. The health-care law also contains racial preferences that may be unconstitutional and were criticized by the Civil Rights Commission.
